1. Agreement to Terms

By accessing our website at kksdesigns.com, placing an order, or using any of our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access our website or use our services.
These Terms and Conditions constitute a legally binding agreement between you ("Customer," "you," or "your") and KK&S Designs, LLC ("Company," "we," "us," or "our").

 

2. Company Information

K&S Designs, LLC is a Maryland limited liability company specializing in custom signage for weddings, events, and corporate clients. We are located in Pasadena, Maryland, and ship worldwide.

3. Changes to This Policy

At KK&S Designs, LLC, we take pride in delivering high-quality custom products with care and professionalism. This Policy outlines our procedures and responsibilities to ensure transparency and trust with our valued customers. 

We reserve the right to update, change, or replace any part of these Terms & Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or services following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes.

4. Products and Services 

KK&S Designs, LLC creates custom signage including but not limited to: acrylic signs, wood signs, foam board signs, welcome signs, seating charts, table numbers, cake toppers, and other event décor. All products are made to order based on customer specifications. 

​

5. Order Processing & Fulfillment 

 

5.1 Order Confirmation 

Customers will receive a shipping confirmation email with tracking details once the order has been dispatched. 

​

5.2 Production Timeline 

Production begins only after: (a) full payment or required deposit is received; (b) design proof is approved by customer in writing; and (c) all necessary information and files have been provided.

6. Quotes, Deposits, and Payment 

​

6.1 Quotes 

All quotes are valid for three (3) days from the date issued unless otherwise specified. Prices are subject to change after the quote expiration date. ​

​

6.2 Deposits 

A non-refundable deposit of 50% is required to begin production on custom orders. The remaining balance is due before the item ships or is available for pickup. 

​

6.3 Payment Methods 

We accept major credit cards, PayPal, and other payment methods as indicated at checkout. All payments must be made in U.S. dollars unless otherwise agreed.

7. Proofs, Revisions, and Approval 

 

7.1 Digital Proofs 

Digital proofs will be provided for all custom orders. Customers are responsible for carefully reviewing proofs for accuracy including spelling, dates, names, colors, and design elements.

7.2 Revisions 

Semi-custom orders include two (2) rounds of revisions. Bespoke/fully custom orders include three (3) rounds of revisions. Additional revisions beyond the included rounds will be billed at $80 per hour. 

​

7.3 Approval 

IMPORTANT: Once the order has been approved and sent to print, no further changes can be made. If the item is printed with an error that was not corrected during the proofing process, you will be responsible for any reprinting costs. Timely communication is crucial. Any delay during the approval period will likely result in a delay in the overall production.

7.4 Design Specifications 

When you receive your proof, it is your responsibility to review it for any errors, including spelling, dates, or punctuation. We allow less than 24 hours for the approval process for revisions if necessary. 

We allow for two minimal revisions, such as changes to font, color, word placement, or minor adjustments. Any revisions that require changes in shape, size, or overall design will incur a $25 charge per item. The fee for a digital proof is $25 (includes 2 rounds of changes), and $50+ for a hard copy proof (digital/offset printing only). 

Once the order has been approved, it will be placed into print production. At this point, no additional corrections or changes can be made. Reprinting fees will be the client's responsibility. Any additional fees for corrections or changes will be added to the balance at the time of pickup.

8. Shipping 

 

8.1 Shipping Methods 

• Tracked Shipping: All full orders are shipped using a trackable service (USPS, UPS, or FedEx). Customers will receive a tracking number once the item has shipped. 

• Sample Packs: Shipped via standard untracked mail to keep shipping costs low. Please allow extra time for delivery.

8.2 Shipping Timeframes 

• If no specific shipping date is advertised, we aim to ship all products within 30 days, per FTC guidelines. 

• If a shipping delay occurs, customers will be notified and given the option to cancel. 

• We will send you written documentation of the delay.

8.3 Shipping Liability & Risk of Loss 

• Once an order is handed off to the carrier, KK&S Designs is not liable for delays, damage, or loss during transit. 

• Customers are responsible for monitoring their shipments using the provided tracking number. 

• Risk of loss passes to the customer once the order is transferred to the shipping carrier, unless otherwise agreed in writing.

8.4 Incorrect or Incomplete Addresses 

• KK&S Designs is not responsible for packages delayed or lost due to incorrect or incomplete shipping information provided by the customer. 

• Reshipping fees may apply if an order is returned to us due to address errors. 

​

8.5 Lost or Stolen Packages 

• If a tracked package is marked as delivered but cannot be located: 

• Customers should first check with household members, neighbors, or their local post office. 

• KK&S Designs cannot replace or refund items confirmed as delivered by the carrier. 

• Shipping Insurance is available upon request to cover potential losses.

8.6 International Orders 

• We currently offer international shipping to select countries. 

• Customs, Duties & Taxes: International shipments may be subject to additional fees (customs duties, taxes, import tariffs), which are not included at checkout and are the sole responsibility of the customer. 

• Delivery times may vary based on customs clearance procedures in the destination country.

8.7 Refunds for Shipping Issues 

• If your order cannot be shipped or is cancelled due to shipping delays beyond the promised timeframe, a full refund will be issued in accordance with the FTC Mail Order Rule. 

• Refunds for orders cancelled due to shipping delays will be issued within 7 business days for credit card payments. 

 

9. Returns and Refunds

9.1 Custom Products Policy 

IMPORTANT: Because all KK&S Designs products are custom-made to your specifications, we do not accept returns, exchanges, or issue refunds for custom or personalized items unless the item arrives damaged, defective, or was produced incorrectly due to our error. 

This policy is in accordance with Maryland law, which exempts custom and personalized goods from standard return requirements as these items cannot be resold.

9.2 Damaged or Faulty Items 

If you receive your item damaged, defective, or incorrect due to our error, you MUST notify us via email within 24 hours of receiving your order. After this 24-hour window expires, you forfeit all claims for replacement or refund related to damage, defects, or errors. 

To report damaged or faulty items, you must: 

• Email info@kks-events.com within 24 hours of delivery 

• Provide photographic proof of the damage 

• Retain all original packaging materials 

Damaged items qualifying for replacement will be replaced at no cost to the customer. In accordance with Maryland House Bill 194 (effective October 1, 2025), for items that are damaged, faulty, or sent in error, we will provide a prepaid return shipping label or refund your return shipping costs within 30 days of receiving the returned item.

9.3 Cancellations 

Orders may be cancelled within 24 hours of purchase for a full refund, minus any transaction fees. After 24 hours, or once production has begun, orders cannot be cancelled and deposits are non-refundable. 

​

9.4 Refund Processing 

If a refund is approved, we will refund the cost of the product only. Original shipping costs cannot be refunded. Refunds will be processed to the original payment method within 7-10 business days. 

​

10. Printing Variations 

 

Printed colors may slightly differ from those seen on screen. If you are unsure about a color, printed proofs are available on request, at additional cost. Printed samples and printed proofs may not exactly match the finished product due to variations in the print production process. Printing can result in small variations. Minor differences in texture, color, size, and positioning can sometimes occur and are not classed as a fault.

11. Issues Not Covered 

​

11.1 Image Pixelation 

Image quality greatly depends on the type of file that is sent. SCREENSHOTS will be pixelated and are not high-quality images. If the file is a raster (pixel-based) image, increasing the DPI will not improve the quality. The only thing that it will do is decrease the quality. When you increase the resolution, your image editing software does calculations and fills in the space based on those calculations. Since the calculations are not 100%, the quality of the artwork decreases.

11.2 Options to Remedy Image Issues 

a) Find new artwork (scalable vector format if possible) or photo; b) Remake or resend the current artwork or photo (in a higher resolution original format); c) Print as is. 

Please note that if the buyer submits their own artwork, it will be printed as is. Proofs are only sent if KK&S Designs, LLC is providing the design.

12. Intellectual Property and Copyright

12.1 KK&S Designs Ownership 

All designs, graphics, templates, and creative works produced by KK&S Designs, LLC remain the intellectual property of KK&S Designs, LLC. Customers receive a non-exclusive, non-transferable license to use the final product for its intended personal or event purpose. 

​

12.2 Customer-Provided Content 

Customers warrant that any content, images, logos, or materials they provide for use in their order do not infringe on any third-party intellectual property rights. Customers agree to indemnify KK&S Designs, LLC against any claims arising from the use of customer-provided content. 

​

​13. Image Use Policy / Photography and Portfolio Rights 

By providing images to KK&S Designs, LLC, you grant us the right to use these images as we see fit. This includes, but is not limited to, use on our website, social media platforms, marketing materials, and other promotional efforts. Once you submit any images to us, we reserve the right to use, edit, and distribute these images without restriction or compensation to you.

By submitting images to KK&S Designs, LLC, you confirm that you have the legal right to grant us these permissions. If you have any concerns or specific requests regarding the use of your images, please communicate them to us in writing prior to submission. 

​

13.1 Opt-Out 

If you would prefer not to have your stationary image or testimonial published, you can notify us in writing via email at any point and we will remove any images or text as soon as reasonably possible. 

​

14. Testimonials and Gallery Images 

All the testimonials on this website are written by clients of KK&S Designs, LLC. By placing an order with KK&S Designs, LLC, you agree to images of your stationery and any feedback sent via email being published on our website or on any social media platform. If you would prefer not to have your stationery image or testimonial published, you can notify us in writing via email at any point and we will remove any images or text as soon as reasonably possible.

15. Comments, Feedback and Other Submissions 

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. 

This includes all forms of communication including but not limited to: verbal communications (phone calls, in-person conversations, voice messages), text messages (SMS/MMS), social media messaging and direct messages, video messages, and any other electronic or written correspondence. 

We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party's intellectual property or these Terms of Service. 

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality, or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

Your submission of personal information through this website is governed by our Privacy Policy, which can be viewed on our website. 

 

17. Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the service you provide that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the service provided to you or on any related website, including pricing information, except as required by law.

18. Website Use and Prohibited Activities 

You may not use our products or website for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

19. Limitation of Liability 

In no case shall KK&S Designs, LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. 

Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount you paid for the specific product or service giving rise to the claim.

20. Indemnification 

You agree to indemnify, defend and hold harmless KK&S Designs, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

21. Third-Party Links 

Certain content, products and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.

22. Dispute Resolution 

22.1 Informal Resolution 

Before initiating any formal dispute resolution process, you agree to first contact us at info@kks-events.com to attempt to resolve any dispute informally. We will attempt to resolve the dispute within thirty (30) days of receiving your notice.

22.2 Mediation and Arbitration 

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or our services shall first be submitted to mediation. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Anne Arundel County, Maryland.

22.3 Class Action Waiver 

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

22.4 Small Claims Exception 

Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies for small claims jurisdiction.

23. Entire Agreement 

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. 

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). 

Any ambiguities in the interpretation of these Terms of Service shall not be construed against us.

24. Governing Law 

These Terms & Conditions, and any separate agreements, whereby we provide you goods or services, shall be governed by and construed in accordance with the laws of the State of Maryland and the United States of America, without regard to conflict of law principles.

25. Severability 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

26. Force Majeure 

KK&S Designs, LLC shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, or failure of third-party suppliers or carriers.
